Swimming Terms & Conditions

In addition to our Terms of Use, there are additional Terms and Conditions specific to swimming lessons.

All clients are expected to abide by these terms and conditions. In the unlikely event of failing to do so, a customer may be requested to cease lessons with The Active Academy. A refund will not be eligible in these circumstances.

Attendance

Swimmers, parents, guardians, siblings or all other associates, must observe the venue’s entry rules and respect all other venue rules whilst in the venue. Facility staff shall retain the right to refuse admission. It is imperative that swimmers are on poolside no more than 5 minutes before the commencement of each lesson and (in the case of child swimmers) should be collected from the pool no more than 5 minutes after the lesson has ended.

No child will be released until they are collected by an appointed responsible adult. The responsible adult must remain in the venue premises for the duration of the lesson. No refund or “catch-up lesson” will be offered where a child fails to attend or is refused permission to attend any sessions.

Behaviour

In the event of a swimmer, parent, guardian, sibling or other associate refusing to obey an instruction from a member of staff, behaving in an unruly manner towards a member of staff or any other person, or causing damage to pool premises or any of the furniture fixtures or equipment in those premises, the swimmer shall not be permitted to continue with the lessons. The Active Academy shall then have the right to terminate the contract without further notice and without being required to offer any credit or refund to the swimmer and the swimmer shall not be accepted for any future course.

Condition of Pool Premises

Whilst The Active Academy will make all reasonable efforts to ensure that the condition of the pool premises, including the changing rooms, washing facilities, the pool and poolside area are in suitable condition, they do not accept liability for any injury to a swimmer which may be caused by any defect and further advise that any claim arising from such a defect must be addressed to the proprietors of the pool premises.

Illness

Any swimmer known to be or found to be suffering from any infectious ailment or condition will not be allowed to participate in the lesson and it is the responsibility of each swimmer or (in the case of a child swimmer) the parent or guardian of the swimmer to ensure that the swimmer is fit and well enough to participate. The Active Academy will not accept liability for any infection passed to a swimmer by another swimmer on the course or in the pool.

Should the swimmer have, or develop, any known or suspected medical condition they must consult their doctor before taking them swimming and inform us. All information received is treated in confidence and with sensitivity.

Swimmer must not enter the pool if they have any illness such as an ear infection, diarrhoea, chicken pox, impetigo, conjunctivitis or merely a bad cold. They must wait until the doctor has given the all-clear before returning to classes.  In the instance of sickness and diarrhoea the child must have been clear of all symptoms for at least 48 hours before attending a lesson.

Medical Conditions

Swimmers must declare any existing medical conditions that they are aware of that the child, or adult if taking lessons, has which may be communicable or possibly be harmful or not to another person.

The client must notify us of any changes in any medical condition or psychological condition as soon as they are aware of them. All information will be kept strictly confidential.

Physical Contact

As part of learning to swim, there will be physical contact between the teacher and swimmer. Permission will always be sought before contact is made and will be conducted in a safe and professional manner. In the event of an emergency, i.e. drowning or submersion, contact may be made without permission.

Swimming Rules and Regulations

  • Swimmers must shower before entering the pool.

  • Children aged 8years and above should get changed in the correct sexed changing rooms.

  • Swimmers should wear bathing caps, for reasons of hygiene & safety where it is mandatory to do so.

  • No swimmer should enter the Pool Area without a member of The Active Academy staff being already present.

  • Children who are not toilet trained should wear an appropriate swim nappy.

  • Swimmers should not enter the pool until the teacher says it is safe to do so and must tell the teacher if leaving the pool before the end of the session.

  • Swimmers should inform the teacher of any health issues that may be relevant.

  • Swimmers must follow the rules of the venue, which involves no running on poolside.

  • Swimmers must not come to the lesson if they feel unwell.

  • There must be no food or drink in any of the pool facilities.

  • Swimmers, siblings, parents and guardians are expected to observe the no smoking policy.

  • No outdoor shoes are to be worn on poolside – If you wish to speak to our swimming teacher then please either remove shoes & socks or put on shoe covers before you go onto poolside.

Lesson changes and pool closures

In the event of an instructor being absent for a lesson, to avoid disruption we may change the instructor to make sure that the lesson is covered.

In the unlikely event of a ‘last-minute’ change or cancellation due to illness, accident, pool closure or any other unpredicted event, we endeavour to notify the client via phone and email as soon as possible.

The Active Academy will always try to reschedule any lesson that has not been able to occur, and the client will always be notified of any changes as soon as possible.

Lost or damaged property

All property left in changing rooms, or on poolside, and all property (including prams) left in entrance halls, outside buildings and car park are left entirely at the client’s own risk. This also applies to any property damaged during lessons. The Active Academy cannot accept any responsibility for the loss or damage to any personal possessions.

Photography

Photography and recording is not permitted in the swimming pools or changing rooms we use, if any members of the public are present.


Photography and recording in the changing rooms is not permitted under any circumstance.
